Fines and Legal Risks: Schools Under Pressure Over Headscarf Ban

Schools in Vienna are expressing growing concern ahead of a new headscarf ban for girls under 14, set to take effect in the 2026/27 school year, with educators warning of potential challenges once fully implemented.

The policy prohibits head coverings that “cover the head according to Islamic traditions,” regardless of whether they are worn for religious, cultural, or personal reasons. During the current information phase, authorities have instructed teachers to report any violations immediately or risk being accused of dereliction of duty.

Educators fear the regulation could strain relationships with students and parents, while also complicating their daily work. Teachers’ representative Paul Kimberger highlighted concerns about whether schools will receive sufficient support from authorities or be left to manage the situation alone.

The enforcement process is strictly defined. Teachers must first ask students to remove the headscarf, and if they refuse, school management must be informed immediately. Repeated violations can lead to involvement from regional education authorities and potential fines ranging from €150 to €800. Staff who fail to report incidents could face legal consequences.

The measure has already drawn criticism from legal experts, religious groups, and NGOs, who warn it may harm trust between teachers and students and lead to the stigmatization of Muslim girls. Concerns have also been raised about possible violations of equality and religious neutrality.

A similar ban was overturned in 2020 by Verfassungsgerichtshof, which ruled that targeting a specific religious group conflicted with state neutrality. The Islamische Glaubensgemeinschaft in Österreich has indicated it will challenge the new law, arguing that it raises similar constitutional concerns.
