Vienna tightens child protection laws and expands intervention powers

The city of Vienna has launched public consultations on extensive amendments to the Child and Youth Care Act, in a move aimed at enhancing the protection of minors from violence, neglect, and exploitation through clearer rules and broader powers for the relevant authorities.

The proposed amendment focuses on early detection of risks, organizing intervention procedures, and enhancing cooperation between government entities and specialized institutions, with the aim of ensuring a faster and more effective response when children face dangerous situations.

The youth affairs advisor in Vienna, Bettina Emmerling, stated that the essence of the reform lies in improving the protection of children and youth, clarifying responsibilities, and early detection of risks. She explained that one of the key elements is to require all public and private institutions working in the field of child and youth care to implement child protection concepts, establish standardized procedures for identifying risk cases, professional conduct rules for workers, and appropriate response mechanisms.

For his part, Vienna City Council member and spokesperson for family and childhood issues Markus Grimpl emphasized that child protection must become a daily practice based on clear rules and early intervention. He confirmed that the goal is to ensure that every child in Vienna grows up in a safe and supportive environment, within a system that does not leave any child without support.

The amendment includes expanding access to records related to crimes, sexual assaults, and violence, so that it is not limited to those working directly with children, but also includes close individuals such as babysitters and private tutors. It also grants child and youth care services broader powers to investigate suspected danger cases, requires parents to cooperate, and allows for the documentation of injuries when necessary. It also regulates the exchange of information between institutions, introduces new data protection rules for private child care service providers, enhances child care arrangements in crises, and opens the field for additional specialists such as psychologists and psychotherapists to work in this sector.
