The winter tire law in Austria comes into effect on November 1: fines of up to 10,000 euros for violators

Starting from November 1, the rules regarding winter tires will be enforced in Austria. The law requires all drivers to use appropriate winter equipment when there is snow, ice, or mud on the roads. Anyone caught driving with summer tires in such conditions may face a fine of up to 10,000 euros.

Winter tires are those that bear the markings 'M+S' or 'MS' or 'M&S' (which means 'mud and snow'), and the tread depth must be at least 4 mm for radial tires and 5 mm for diagonal tires. Since 2018, tires bearing a mountain symbol with a snowflake, known as the Alpine symbol, have also been legally recognized, providing better stability and higher safety in cold and slippery conditions.

Experts advise changing tires early before temperatures drop significantly. Stefan Kirbl from the Austrian Automobile Club (ÖAMTC) stated that maintenance workshops are very busy during the first cold wave. He added, "Even if the weather is mild during the day, early switching is safer. Winter tires provide better performance during cold nights and in mountainous areas." The club also recommended checking the tread depth before installation and replacing old tires that have exceeded six seasons of use.

Drivers who use summer tires during winter conditions face strict penalties. The minimum fine starts at 100 euros and can reach up to 10,000 euros if other road users are put at risk. In the event of an accident, the driver must prove that the accident would have occurred even if winter tires had been used, otherwise they may bear part of the responsibility. Insurance companies may also reduce or deny compensation if the appropriate tires are not used.

Recent tests showed the failure of eleven models of winter tires due to poor grip on snow, long stopping distances, or rapid wear. Experts advise not to focus solely on price or brand when buying tires, but also on grip and braking performance on wet roads — especially for older cars that lack modern assistance systems.

Drivers who are driving outside of Austria must also pay attention to local laws. In Germany, the law requires the use of winter tires when there is snow or ice, and starting from October 2024, only tires with the Alpine symbol will be allowed — even for vehicles registered in Austria. In Italy, Switzerland, and Slovenia, the laws are stricter and include immediate fines for violators.
