Sharia Ban - The Minister Issues a Firm Statement

Austria is heading towards a heated political debate following Interior Minister Gerhard Karner's announcement of his intention to ban the application of Sharia law, reigniting disputes within the ruling coalition and drawing widespread attention to how to deal with foreign laws within the country.

The case gained momentum after a controversial court dispute earlier this year, in which it was said that Islamic legal principles known as Ahl al-Sunnah wa al-Jama'ah (Sharia) were applied. Since then, the Austrian People's Party (ÖVP) has been pushing strongly for a clear legal ban.

During his speech at a media event, Interior Minister Gerhard Karner confirmed that the ban on Sharia is planned and will be implemented. He explained that negotiations are still ongoing, but he did not provide details about the legal mechanism through which this ban will be applied.

In contrast, the positions of coalition partners appeared more cautious. The State Secretary for Security, Jörg Leichtfried of the Social Democratic Party (SPÖ), emphasized that any rules undermining the rule of law have no place in Austria, without clarifying the practical form of any potential ban.

The Ministry of Justice, led by the SPÖ party, confirmed that legal systems that violate women's rights and human rights are not recognized as public legal systems in Austria. It clarified that Austrian courts only apply foreign laws if they are consistent with Austrian values, especially within the framework of private international law.

The ministry also warned against making hasty decisions, pointing out that any amendments could affect family law, custody rights, alimony, and international legal relations. It clarified that a working team is currently studying the need to amend the existing rules regarding the application of foreign laws, with no draft law ready yet.

On his part, legal expert Peter Busiager clarified that Sharia is not generally applied in Austria. He emphasized that individuals may privately agree on a specific law in contracts, but within strict limits that respect equality, non-discrimination, and Austrian constitutional principles.
