A court ruling compels Jobcenter to pay the full rent

In an important court ruling, the social court in Munich decided that job centers (Jobcenter) must pay the actual rental costs for recipients of Bürgergeld if they do not have a clear plan to determine an acceptable rent ceiling. This decision provides significant relief to many beneficiaries, especially amid ongoing debates about the 'reasonableness' of housing costs.

In Germany, the job center usually covers the housing costs for recipients of Bürgergeld, provided that these costs are 'reasonable', as stipulated by law (§ 22 Abs. 1 Satz 1 SGB II). However, the criteria used by job centers to determine this reasonableness vary from municipality to municipality and are often unclear or unjustified.

The court found that the burden lies on the job center to prove that the costs it determines for housing are sufficient to secure a minimum standard of living, as well as to prove that the rents demanded by the beneficiaries are unreasonable. In a particular case, the job center refused to pay the rent without sufficient clarification, prompting a beneficiary to file a lawsuit that ended with a ruling in her favor.

The ruling clarified that in the absence of a clear and justified plan from the workplace, actual housing costs should be adopted as a criterion for need, as the data relied upon by the center is insufficient to determine whether the costs are reasonable or not. The court added that using a housing allowance table plus 10% is not enough to secure a minimum standard of living if it is not supported by a sound plan from the center.

The ruling also indicated that the refusal to use actual costs in these cases constitutes a violation of the affected parties' right to effective legal protection, according to Article 19, Paragraph 4 of the German Constitution (Grundgesetz).

In a related context, the upcoming government led by "Merz" intends to radically amend the Bürgergeld system, which will henceforth be known as the "basic guarantee for job seekers." The conditions are expected to become stricter, with a reduction in the grace periods related to personal wealth and a definition of what is considered unjustified housing costs. This judicial decision strengthens the rights of Bürgergeld beneficiaries in the face of job centers and sets a legal precedent that could affect thousands of future cases in Germany.
