Judicial ruling! Islamic law also applies in Austria

The regional court in Vienna for civil matters (LGZ) issued a controversial ruling in a dispute between two men, raising questions about the role of Islamic law in Austria. The parties had previously agreed that any contractual dispute between them would be resolved according to Islamic law, specifically 'Ahl al-Sunnah wa al-Jama'ah', in addition to principles of justice and fairness.

When the dispute between them actually arose, the two men resorted to arbitration as stipulated in their agreement. The arbitration panel ruled against one of them and ordered him to pay 320,000 euros. This decision was based on the specific agreement between the parties, which allowed the use of Islamic law as a reference for resolving the dispute.

However, the man against whom the ruling was issued objected to the outcome, asserting that the application of Islamic law in such cases is problematic due to the multiple interpretations among scholars, which makes the ruling arbitrary. He also pointed out that introducing Islamic law into the case contradicts the fundamental principles of Austrian law.

The court faced a complex question about whether agreements that stipulate the resolution of disputes using religious laws can be recognized within the framework of Austrian civil law. Although private arbitration is permitted in Austria, the dispute centered on whether the application of Sharia could undermine the core values of the country's legal system.

This ruling has sparked a wide discussion about the limits of religious arbitration and the validity of private agreements when they are based on legal systems that differ from those in force in Austria. It also highlighted the existing tension between respecting private contractual freedom and ensuring the protection of legal standards and constitutional values of the state.
