Prison chaos! - Hundreds of criminals may be released due to overcrowding

Hundreds of prison sentences in Nederland (the Netherlands) could expire without being served due to severe overcrowding in prisons, raising serious concerns about the justice system.

The Ministerie van Justitie en Veiligheid (Ministry of Justice and Security) confirmed that 658 cases involving 534 individuals are at risk of becoming time-barred in 2026. These cases together account for a total of fourteen years of prison sentences.

Most of the affected cases involve short prison terms ranging from one to sixty days, typically linked to minor offenses such as theft or unpaid fines. Authorities say individuals whose sentences are close to expiring will now be prioritized to serve their time.

Due to the shortage of prison capacity, many offenders remain at home while waiting to begin their sentence. In addition, police are not actively tracking individuals with sentences shorter than sixty days, further increasing the risk that these punishments will expire.

In response, a majority in the Tweede Kamer (House of Representatives) is pushing to convert these prison sentences into alternative punishments using an enkelband (ankle bracelet), rather than allowing offenders to avoid punishment entirely.

The statute of limitations varies depending on the severity of the crime, typically ranging from three to five years for minor offenses and up to twenty years for serious crimes. However, the current prison capacity crisis is accelerating the risk of sentences lapsing.

The shortage of prison cells and staff has been a long-standing issue. Since last year, inmates serving sentences of up to one year have already been allowed to leave prison two weeks early, highlighting the growing pressure on the system.
