The judiciary triumphs for you after being compared to Hitler!

In a significant legal development, the Supreme Court of Austria resolved a legal dispute in favor of the leader of the Austrian Freedom Party (FPÖ), Herbert Kickl, after he was compared to Adolf Hitler in a controversial election campaign in 2024. The court ruled that this comparison was unacceptable.

The case goes back to a campaign launched by the Verein "Plattform Demokratie" against the use of the term "Volkskanzler" (Chancellor of the People), where an image of Kickl was shown in a video alongside symbols and images referring to the Nazi regime and Hitler. The FPÖ party quickly filed a lawsuit, demanding the cessation of the use of the image and financial compensation.

The commercial court in Vienna ruled in favor of the party in January, prohibiting the use of the Kikl image in contexts that refer to Nazism or attribute Nazi goals to it. The court also awarded a financial compensation of 4000 euros in favor of Kikl. The matter did not stop there, as the court obliged the defendant to publish the full ruling through Google Ads for three months directed at the same audience targeted by the original campaign.

Despite "Plattform Demokratie" filing an appeal against the ruling before the Supreme Court in Vienna, the latter rejected the appeal, confirming that the video exceeded the limits of permissible political criticism, and that the term "Volkskanzler" does not provide a substantive justification for linking it to Nazism. The court noted that this term had previously been used in democratic contexts, such as describing politicians Bruno Kreisky and Ludwig Erhard. When the legal team of the defendant, led by lawyer Maria Windhager, appealed to the Supreme Court, the result was the same: a final rejection of the appeal and the confirmation of the ruling.

On his part, FPÖ spokesman Christian Hafenecker expressed his satisfaction, saying: "It is unbelievable how far the smear campaigns against our party have gone just before the 2024 elections. We have defended ourselves legally and won the case completely." Notably, one of the individuals behind this campaign is Robert Luschnik, who previously held leadership positions in the Green Party and Neos, and currently serves as the parliamentary group leader for Neos. This connection has drawn severe criticism from the FPÖ. Hafenecker concluded his statement by saying: "It is concerning that someone who launched a campaign of this level of distortion still holds an important position within parliament."
