AMS benefit suspension: 3,166 cases in Lower Austria in the first half of the year
Between January 1 and June 20, 2026, the AMS Lower Austria issued 3,166 notices under Section 10 of the Unemployment Insurance Act. Each of these cases involves a suspension of unemployment benefits or emergency assistance. The suspension lasts for six weeks, or eight weeks in the case of a repeat offense.
A suspension is possible if a reasonable job offer is refused – or if an individual prevents the establishment of an employment relationship through their own behavior. The law refers to this as preventing employment. This also includes attending a job interview solely to obtain confirmation of attendance. If this happens multiple times within a year, benefits can be terminated entirely: this occurred 241 times in Lower Austria in the first half of the year. The entitlement only resumes once the affected person takes up fully insured employment.
The state manager of AMS Lower Austria, Sandra Kern, puts the figures into perspective: "Our goal is not the suspension, but a rapid return to work." She stated that the notices are issued after careful review; most clients want to work and are supported with counseling, job offers, and qualifications.
For those affected, the practical aspect is the most important: reasonableness is not a feeling, but an assessment – and this assessment only takes place if the AMS has the necessary information. Anyone who is unsure whether a job offer is suitable should therefore not wait, but speak quickly with their assigned consultant. Current documentation is helpful: medical reports, proof of care obligations, information on previous employment, and commute times. On this basis, the AMS can determine which activity is actually reasonable.
Equally important is the simplest protection of all: attending scheduled appointments. An appointment missed without an excuse is the most common reason for suspension across Austria. Anyone who is unable to attend should notify the office in advance – it costs nothing and prevents weeks of payment loss. And anyone who has already received a suspension notice should observe the legal appeal period mentioned therein and explain the reasons in writing, rather than simply accepting the suspension.
