Ritual circumcision in Europe: what is the legal framework?

The question of ritual circumcision in young boys is regularly the subject of debate within the European Union. This practice, performed for religious or cultural reasons, raises questions about the balance between freedom of worship and children's rights.

Currently, there is no legal ban on non-medical circumcision of boys in European countries. Although some countries have discussed potential restrictions, legislation remains permissive across the continent, including in Belgium.

In Belgium, the practice is authorized and commonly performed in a medical setting. Health and legal authorities consider that as long as the procedure is carried out under appropriate hygiene and safety conditions, it complies with current standards. Parents retain the right to decide on this intervention for their children according to their personal convictions.

The debate, however, remains complex. On one hand, religious communities, particularly Jewish and Muslim, defend circumcision as a fundamental pillar of their identity and tradition. On the other hand, some child rights advocates believe that the intervention should be postponed until the child is old enough to give their own consent.

For the time being, the status quo prevails in the majority of member states. No common European legislation is planned to change these rules, leaving each country free to define its own legal framework while respecting the principles of religious freedom and public health protection.
