Wilders' immigration plans spark widespread legal controversy

Geert Wilders, leader of the PVV party, announced that his patience has run out, demanding immediate and strict action on asylum and immigration in the Netherlands. Among his main proposals are: closing the country's borders to asylum seekers within weeks, shutting down asylum centers, and forcibly returning all Syrians to their country.

Wilders threatened to withdraw from the government coalition if these measures are not implemented quickly, increasing pressure on the partner parties. However, the implementation of these plans faces significant legal obstacles, due to the Netherlands' commitment to international agreements, such as the 1951 Refugee Convention and the European Convention on Human Rights, which guarantee the right to apply for asylum and prevent the rejection of individuals at the borders.

Although some countries like Finland have imposed restrictions on the passage of refugees, these measures have been criticized by the United Nations for violating international laws, setting a controversial precedent in Europe. Additionally, several European countries have been lenient in applying asylum agreements, amid silence from the European Commission due to political pressure from the far right.

Wilders also calls for a temporary halt to family reunification processes, considering them a significant burden on the state. However, this right is guaranteed under European and international agreements. In Austria, family reunification has been temporarily suspended, but the law is still under debate regarding its resilience in court. In the Netherlands, family reunification laws have already been tightened, now requiring the resident to prove the existence of housing and income before bringing their family.

As for the Syrians, Wilders wants to return them within six months, even if it requires force. However, he faces a legal obstacle: Syrians can only be returned after the Ministry of Foreign Affairs declares that Syria is safe, and there must be agreements with the Syrian regime to accept the returnees. Without that, forced return remains legally and practically impossible.

Wilders wants to revoke Dutch citizenship from dual nationals convicted of sexual or violent crimes. However, he needs strong legal grounds and judicial support for that. In Germany, the police have started to turn away asylum seekers at the border, relying on European emergency laws, but they still face legal objections.

Among other plans by Wilders that may receive coalition support: accelerating police intervention during demonstrations. The government is currently considering how to distinguish between peaceful protests and riots without infringing on freedom of expression.

However, experts question the police's ability to implement these interventions quickly and efficiently, especially when dealing with large crowds. Ultimately, legal experts believe that most of Wilders' proposals, such as expelling criminal refugees or revoking citizenship, are currently impossible within the framework of EU laws. These plans collide with strict limits imposed by European law on member states.
