Government plans changes to the taxation of family foundations
The government has adopted a new draft law that introduces significant changes to the rules for taxing family foundations in Poland. The purpose of these regulations is to seal the tax system and clarify the provisions regarding the management of assets contributed to foundations.
The most important change concerns the method of taxing the sale of assets that have been transferred to a foundation by its founders. According to the new draft, the sale of such assets will be subject to taxation, which is intended to limit the ability of foundations to avoid public levies.
Experts point out that family foundations have become a popular tool in recent years for protecting assets and planning succession in Polish companies. The new regulations aim to ensure that the activities of these institutions are more transparent and consistent with the general tax principles in force in the country.
The draft law will now proceed to further work in parliament. Entrepreneurs and those managing family foundations should closely monitor the legislative process, as the new rules may affect asset management strategies in the near future.
The final shape of the regulations may still change during the debate in the Sejm. The government emphasizes that the changes are necessary to ensure that the tax system is fair for all market participants.
