A 10-billion lawsuit: why wind power plants in the Kherson region are suing their insurer

The Supreme Court of Ukraine has begun hearing a large-scale legal case concerning the operations of wind power plants in the Kherson region. The subject of the dispute involves financial claims totaling approximately 10 billion hryvnias. This case has attracted the attention of experts due to the involvement of a major international company.

The primary defendant in the legal proceedings is the insurance company "UNIQA," which is part of the Austrian UNIQA Insurance Group. The conflict arose due to the alleged failure of the insurer to fulfill its obligations regarding renewable energy facilities that were damaged as a result of military actions in southern Ukraine.

Representatives of the wind power plants are insisting on compensation for damaged equipment and lost property. In turn, the insurance company is attempting to prove that the situation falls under exclusions provided for in the insurance contracts, specifically due to force majeure circumstances caused by the war.

The Supreme Court's decision in this case could set a precedent for the entire energy sector of Ukraine. Since many critical infrastructure facilities have been damaged, the outcome of these proceedings will influence how Ukrainian enterprises collaborate with international insurance groups in the future.

Currently, the court hearing is ongoing, and the parties continue to present evidence. The public and the business community are awaiting a final verdict, which will determine who will bear financial responsibility for the damages caused to the country's energy system during the hostilities.
